Independent Professional Advocacy
An independent professional advocate is a statutory role under the Social Services and Well-being (Wales) Act 2014 (SSWBA). They play a crucial role in supporting citizens who may have difficulty in representing their own interests. These advocates are tasked with ensuring that citizens’ voices are heard, their rights are protected, and their preferences are considered in decision-making processes concerning their care and well-being.
The SSWBA (2014) sets out the occasions when local authorities in partnership with an individual must consider the role of advocacy. These include, but are not limited to:
When making decisions that will have a significant impact on the persons’ day to day life.
When external factors impact on their care and support arrangements, for example, provider failure, care home closure, changes of management or ownership arrangements in care homes.
When suspected of being at risk of harm or neglect or subject of safeguarding concerns.
When preparing to leave hospital and return to the community.
Key responsibilities
- Representation and Support: Assisting citizens in articulating their needs, preferences, and views in discussions with social services and other relevant organisations.
- Information: Providing clear information about their rights, options, and available services, enabling informed decisions.
- Ensuring Fair Treatment: Safeguarding the citizen’s interests, ensuring that decisions are made fairly and transparently.
- Empowerment: Helping citizens gain the confidence and skills to self-advocate in future situations.
IPAs operate independently of service providers to maintain objectivity and focus solely on the citizen's wishes and feelings.
